(Project-Based – Furniture, Fixtures & Equipment)

1. Warranty Statement

Absolute Office Furniture (“Absolute”) warrants to the original Project Owner/Operator that all furniture and FF&E products (“Products”) supplied and installed are:

  • Manufactured in accordance with approved shop drawings, specifications, and control samples;

  • Suitable for intended commercial hospitality use under normal operating conditions.

This warranty is issued solely to the contracted client/project owner and forms part of the project deliverables.

2. Warranty Period

Unless otherwise specified in the project agreement:

Product Category

Casegoods (guestroom furniture, millwork, built-ins)

Seating – Frames & Structural Components

Mechanisms (sleepers, recliners, hardware systems)

Upholstery, Foam, Finishes

Electrical Components (power modules, lighting)

Warranty Period

2 Years

5 Years

3 Years

2 Years

1 Year

Commencement Date:
The warranty period begins upon Substantial Completion or installation, whichever occurs later.

3. Project Conditions & Installation

This warranty is valid only where:

  • Installation is performed by Absolute or its approved installation partners;

  • Site conditions are suitable for installation (level surfaces, completed construction environment);

  • Products are used in accordance with intended hospitality usage standards.

Absolute shall not be responsible for damages arising from incomplete construction, improper site readiness, or interference by other trades.

4. Inspection, Punch List & Acceptance

  • Any deficiencies must be documented in a formal punch list.

  • Items not identified at acceptance are deemed accepted as compliant, except for latent manufacturing defects.

5. Warranty Coverage

This warranty covers:

  • Structural defects (frames, joints, internal supports)

  • Manufacturing defects inconsistent with approved samples

  • Failure of mechanical components under normal commercial use

Absolute will, at its sole discretion:

  • Repair defective products on-site;

  • Replace defective components; or

  • Replace the product or issue a credit (pro-rated if applicable).

6. Exclusions

This warranty does not cover:

  • Normal wear and tear (scratches, dents, fabric wear, finish aging)

  • Damage from misuse, abuse, or improper housekeeping practices

  • Use of non-approved cleaning chemicals or methods

  • Damage caused by guests beyond intended use

  • Site-related deficiencies (uneven walls, flooring issues, structural movement)

  • Moisture, humidity, or environmental exposure outside design conditions

  • Damage caused by third-party contractors

7. Unauthorized Modifications

Any modification, alteration, repair, or reinstallation by parties other than Absolute will:

  • Immediately void all warranties; and

  • Release Absolute from any further liability or performance obligations.

Once Products are modified by third parties, Absolute cannot guarantee structural integrity, safety, or compliance with original specifications.

8. Site Condition Disclaimer

Absolute shall not be responsible for any deficiencies arising from:

  • Uneven or non-level walls, floors, or building structures

  • Construction tolerances or dimensional inconsistencies

  • Misalignment caused by building conditions

Any such issues are explicitly excluded from warranty coverage, even if discovered post-installation.

9. Furniture–Site Coordination & Responsibility

Absolute’s scope is limited to furniture supply and installation.

Absolute is not responsible for coordination failures related to:

  • Electrical outlets or rough-ins

  • Wall blocking, backing, or mounting conditions

  • Other trades’ work affecting furniture alignment or fit

10. Claim Procedure

To submit a warranty claim, the Owner/Operator must:

  1. Provide written notice within 30 days of discovery

  2. Include:

    • Project name and location

    • Product identification

    • Description of issue

    • Photographic evidence

Absolute reserves the right to conduct on-site inspection prior to claim approval.

11. Service & Response

  • Initial response: within 5–10 business days

  • Service timeline subject to product availability and site conditions

  • Work scheduled to minimize disruption to hotel operations

12. Set-Off & Commercial Adjustment

  • Where Absolute has supplied goods or services to related parties involved in the project (including ownership, property, or affiliated entities), Absolute reserves the right to:

  • Apply commercial set-offs or adjustments between outstanding balances;

  • Reconcile accounts based on mutually agreed offsets;

  • Withhold warranty services for accounts that are materially overdue or disputed.

13. Insurance & Liability Alignment

  • Absolute Office Furniture maintains commercial general liability insurance coverage of $5,000,000 (CAD), subject to annual review and renewal, applicable only to products as originally supplied and installed.

  • However:

  • Insurance coverage does not extend to modified or altered products;

  • Any third-party modification voids both warranty and related insurance coverage;

  • Absolute shall not assume liability for any damages arising after unauthorized alterations.

14. Limitation of Liability

To the maximum extent permitted by Canadian law:

  • Absolute’s liability is limited to repair, replacement, or credit;

  • Absolute shall not be liable for:

    • Loss of revenue

    • Business interruption

    • Guest claims or operational losses

    • Indirect or consequential damages

15. Transferability

This warranty is non-transferable, except with prior written consent from Absolute for the same project location.

16. Governing Law

This warranty shall be governed by the laws of the British Columbia in which the project is located, and applicable federal laws of Canada.
